UPOA and Limitation

Here is the Court of Appeal decision on the LSCs appeal in the Henshaw case. Not good reading.

  • Not exactly good news; however, part of item 67 is interesting.

    “I would have thought that there must be a strong argument for saying that the court had power to amend a certificate, on the application of counsel (or the solicitor or indeed the Commission), if satisfied that the assessment mistakenly excluded an item (e.g. in respect of counsel’s fees) and that no prejudice would be caused by amending the assessment and certificate accordingly.”

    This seems contrary to the LSC’s assertion on the bottom of CLAIM1s and CLAIM1As that “If no, please note the case will be closed and you will be unable to submit further claims.”
