Damned if You Do…..

In our work we see a lot of Family files. These might be those on which Helen and I write costs appeals or those to which the Costs Drafting team apply their arcane skills. It is in the former arena we see most attempts at mediation. More often than not they are just attempts, and failed ones at that. Many of these cases will not continue to litigation but a sizeable proportion will and it is these to which Resolution refer in this piece. As the commentator to the article points out if mediation is proposed as a solution to LA cuts it is far from a complete one.

Perversely, of course, the Point of Principle I wrote yesterday involved the refusal of a Level 2, Family Help (lower) claim, and a Settlement Fee, on a case which had resolved via Mediation.
