I have just written another ECF redetermination for a firm with a desperate and vulnerable client*. The common feature is how a McKenzie friend can mitigate a “substantial disadvantage compared to the opponent”. In this one there is also an undue reliance placed upon the good offices of the Court to further reduce any disadvantage. The twin efforts of Court staff and McKenzie advisers therefore remove the need for ECF Legal Aid for all time.
*Prediction this will prove a complete waste of time.
