Family firms will need to become familiar with Practice Direction 25b regarding the instruction of experts in Children cases.

The LAA have also made changes in response with the key requirement being:

Providers must have systems in place to evidence that the experts they use meet the standards. This would typically involve retaining copies of an expert’s CV and signed ‘statement of truth’.

When making applications for expert witness funding, providers will need to confirm that their instructed expert meets the standards.

That’s right another reason for bill rejections.

There is no “transitional protection” either it applies to all experts instructed after 1st October regardless of the age of the case.
